Foreclosure Defense & Loss Mitigation
Foreclosure Defense & Loss Mitigation
The Current State of Foreclosure Activity in Florida
Florida homeowners are facing renewed pressure. In the first half of 2026, Florida posted the nation's highest foreclosure rate — roughly one in every 373 homes, or about 0.27 percent of housing units, with 27,494 properties recording a foreclosure filing.
Several pressures specific to Florida are driving the trend. Property insurance premiums have increased by more than 40 percent in some areas since 2023, and following recent structural-safety legislation, many condominium associations have imposed substantial special assessments for building repairs and reserves. Rising HOA fees and the expiration of pandemic-era protections add further strain, while mortgage rates hovering in the 6 to 7 percent range continue to burden adjustable-rate and newer borrowers.
How We Can Help
At the Law Offices of Anthony Rumore, P.A., we know that the threat of losing your home is overwhelming — and that the flood of mailers you may be receiving from non-attorneys only adds to the confusion. We are a law firm. We represent you, and we work directly with your lender on your behalf.
Every case begins with a free consultation, where we review your mortgage, your notices, and where your case stands. From there, our goal is to keep as many options open as possible. On the loss mitigation side, that can mean pursuing a loan modification, reinstatement, a repayment or forbearance plan, or — where staying in the home is not the goal — a short sale or deed in lieu of foreclosure.
When a lawsuit has already been filed, our foreclosure defense work focuses on holding the lender to its burden of proof. Because lenders must file their papers in the public record, those papers can be examined closely, and they are not always in order. We review the note, the chain of ownership, the lender's standing to foreclose, and the required notices, and we raise every appropriate defense on your behalf while continuing to negotiate toward a resolution you can live with.
What Is A Short Sale?
A short sale, also known as a “negotiated settlement” or “short pay”, occurs when the lender agrees to accept less than the amount owed to satisfy a loan as an alternative to foreclosure. All mortgage lenders have several layers of bureaucracy, insurers, and investors that must be negotiated with to get a short sale approved. We are extremely experienced at negotiating with mortgage lenders. We can assist you in the short sale process by:
Helping you to identify an experienced listing real estate broker and directing the activities of that broker. Our office will negotiate with potential buyers on your behalf, prepare all agreements, contracts, and addenda, and submit requisite preliminary settlement closing statements to the lender.
We will also issue title insurance for the purchase and close the transaction, if agreeable to the parties.
Our staff will communicate with all the parties each step of the way to make sure that the closing occurs smoothly and within both the buyer's and seller's timelines.
With more than 50 years of combined attorney experience helping Florida homeowners, we will guide you through the process from start to finish. The sooner you reach out, the more we can do. Call 954-942-2414 for a free, no-obligation consultation today.
